Litigation

Overview

We provide comprehensive support in corporate and commercial litigation, representing clients in disputes arising from their business activities, corporate relationships and transactions.

Our work covers every stage of a dispute from initial legal assessment and litigation strategy to court representation and enforcement of judgments.

We act in corporate disputes concerning shareholders' rights, corporate governance and management decisions and in commercial disputes over contractual obligations, including the performance and termination of agreements.

We also defend clients in criminal proceedings involving financial and economic crime, from the initial case assessment and defence strategy through to protecting their rights and legitimate interests at every stage of the proceedings.

Terms in a dispute

  1. Judgment

The adjudication by which a court decides a matter on the merits. Once it has come into lawful effect, it is binding and enforceable throughout the State.

  2. Writ of execution

The document on which enforcement proceeds. The court prepares it once the judgment has come into lawful effect, or immediately on pronouncement where the judgment is to be enforced without delay.

  3. Right to defence

Belongs to any person of whom it is presumed or asserted that they committed a criminal offence: to know what they are suspected or accused of, and to choose their defence position, in person or through counsel of their own choosing.
